1. The Government of Mongolia has received a loan from the Asian Development Bank (ADB) toward the cost of Strengthening ICT Systems for Efficient and Transparent Public Investment and Tax Administration Project, and it intends to apply part of the proceeds of this loan to payments under the Contract for procurement of Supply and install non-IT infrastructure for the data center including power supply and air-conditioning systems as stated procurement plan.

2. The Ministry of Finance (“the Purchaser”) now invites sealed Bids from eligible Bidders for supply and install of non-IT infrastructure for the data center including power supply and air-conditioning systems (2 Lots).

3. Open Competitive Bidding, National Advertisement (Single-stage) will be conducted in accordance with ADB’s Single-Stage: One-Envelope procedure and is open to all Bidders from eligible source countries.

4. Only eligible Bidders with the following key qualifications should participate in this bidding:

Eligibility: Eligibility for participation by Bidders in terms of nationality, conflict of interest, status as government-owned enterprise and sanctions either by ADB or other international development institutions.

5. The Bidder shall submit a bid security in the amount and currency of: Lot 1:17,780,000.00 MNT, Lot 2: 7,750,000.00 MNT

6. Contractual experience: At least 3 similar contracts successfully completed as the main Supplier within the last three years /2017, 2018 and 2019/. Total value of the highest valued 3 contracts shall be at least: Lot1- MNT 712,000,000.00 (or equivalent); Lot 2- MNT 310,000,000.00 (or equivalent). Nature and complexity of these contracts should be comparable to the subject contract. a) Value based on the minimum amount required for all partners of the Joint Venture must meet, taking joint and severally liability into account, at least 25%; and b) Value based on the minimum amount required that one partner of the Joint Venture must meet, at least 40%.

7. Financial Position: The bidder's net worth over the most recent 3 / 2017,2018,2019/ years should be positive. The bidder's profitability will be measured by pre-tax profits and total annual turnover over the recent three years. Higher positive pre-tax profits and turnover over the period indicate higher profitability of the bidder.

8.Cash-flow Capacity : Availability of or access to liquid assets, lines of credit, and other finances sufficient to meet any possible cash flow requirement which is at least for Lot1: MNT 1,000,000,000.00(or equivalent) and for Lot 2: MNT 500,000,000.00(or equivalent). This should in appropriate cases also take into account the Bidder’s commitments for other contracts.

Litigation History: Bidder must not have any pending claims, arbitration, or other litigations. Reference from Metropolitan court that regarding any litigation current or during the last three year /2017 2018 2019/ in which the Bidder is involved, the parties concerned and disputed amount;

9. Interested eligible Bidders may obtain further information from the Strengthening ICT Systems for Efficient and Transparent Public Investment and Tax Administration Project Implementation Unit and the Bidding Document, in the Mongolian language, may be purchased by interested Bidders on the submission of a written application to the address below:

10. Please note that Bidding Documents are issued in hard copies. Interested bidders that purchase a hard copy may also request a copy to be provided by Email. In the event of any inconsistency between the hard and soft copies, the hard copy will prevail.

The Ministry of Finance will not be responsible for any costs or expenses incurred by Bidders in connection with the preparation or delivery of Bids

When comparing Bids, ADB’s Domestic Preference Scheme will not be applied in accordance with the provisions stipulated in the Bidding Document.
